Superior Court Briefs: Feb. 9 - Feb. 14

Cases heard before Judge John Agostini on Friday, February 9.
 
Deidra Walker, 30, of Port Jervis, N.Y. pleaded guilty to a single count of possession of heroin with intent to distribute.
 
She was ordered to serve two and a half to three years at the Massachusetts Correctional Institution at Framingham. 
 
Walker was in possession of the drug when she was arrested in Pittsfield on March 26, 2017.
 
Cases heard before Judge John Agostini on Tuesday, February 13.
 
Jeremy Levernoch, 35, of Pittsfield had not guilty pleas entered on his behalf on four counts of breaking and entering a building in the daytime with intent to commit a felony, three counts of larceny over $250, and single counts of larceny of a firearm and larceny under $250.
 
He was ordered to be held at the Berkshire County House of Correction on $10,000 bail. Levernoch is accused of breaking into homes in Hinsdale, Dalton, and Peru between November 23, 2017 and January 14, 2018.
 
Marquis Williamson, 30, of North Adams had a not guilty plea entered on his behalf on a single count of possession of heroin with intent to distribute - his second offense.
 
He was ordered to be held at the Berkshire County House of Correction on $1,000 bail. The charges stem from a motor vehicle stop in North Adams on November 30, 2017.
 
James Cromartie, 31, of Pittsfield pleaded not guilty to a single count of murder.
 
He was ordered to be held at the Berkshire County House of Correction without the right to bail. Cromartie is accused of shooting and killing James Dominguez III, 30, of Springfield on January 23, 2016. 
 
Cromartie had previously been indicted on a murder charge and this one replaces that. 
 
Jonathan Therrien, 29, of Adams had not guilty pleas entered on his behalf on single counts of improper use of a credit card over $250 and larceny under $250.
 
He was released on $100 bail on these charges but Therrien is currently being held at the Hampden County House of Correction without bail on other charges. The incidents allegedly occurred in Lanesborough and Pittsfield on September 23, 2017.

Christopher Davis, 34, of Pittsfield had not guilty pleas entered on his behalf on single counts of perjury and misleading a police officer.
 
He was ordered to be held at the Hampden County House of Correction on $200,000 bail. Davis is accused of giving false information in a homicide investigation and providing perjured testimony in a grand jury presentation between November 9, 2017 and December 21, 2017.
 
Randy Lambach, 45, of Becket had not guilty pleas entered on his behalf on nine counts of trafficking a person for sexual servitude, seven counts of deriving support from prostitution, and single counts of conspiracy to traffick person for sexual servitude, paying for sexual conduct, and intimidation of a witness.
 
He was ordered to be held at the Berkshire County House of Correction without bail. Lambach is accused of trafficking nine women to engage in commercial sexual activities in Pittsfield between November 1, 2014, and November 14, 2017.
 
Joseph Vanwert, 66, of Pittsfield had not guilty pleas entered on his behalf on five counts of paying for sexual conduct, and single counts conspiracy to traffick persons for sexual servitude and maintaining a house of prostitution.
 
He was ordered to be held at the Berkshire County House of Correction on $7,500 bail. Vanwert is accused of conspiring to traffick women to engage in commercial sexual activity in Pittsfield between November 1, 2014 and November 12, 2017.
     

Pittsfield Man Arrested After Leaving Scene of Accident

PITTSFIELD, Mass. — A 20-year-old Pittsfield man was arrested on Wednesday morning after police said his reckless driving caused him to hit a van and a bridge.
 
Trevor Maffuccio was charged with leaving the scene of a personal injury accident, leaving the scene of a property damage accident, and reckless operation of a motor vehicle. Maffuccio was arraigned in Central Berkshire District Court.
 
Maffuccio was driving north on Holmes Road when he reportedly crossed a double yellow line to pass the vehicle in front of him at a high rate of speed and collided nearly head-on with a southbound van, spun out of control, struck the bridge, and went off the roadway into the woods. The van's operator and other witnesses then observed Maffuccio's vehicle drive back onto the roadway and leave the scene. 
 
The driver of the vehicle that was passed reported that Maffuccio "had been following and tailgating him since they were on Route 7." The van's operator had to swerve to prevent a head-on collision.
 
Police responded to the report of the accident at Holmes Road and Shetland at about 10:23 a.m. While heading toward the accident, Officer Brandon Gallagher observed a red sport-utility driving eastbound on Williams Street. The SUV, which had extensive damage to it, was being operated at a slow speed with its emergency flashers on.
 
"Gallagher noted the vehicle's side airbags had been deployed and that although the vehicle was being driven, one of its tires was underneath it," according to the police statement.
 
Maffuccio was driving the SUV and admitted to being involved in the Holmes Road accident when Gallagher stopped him. 
 
A passenger in the van, Shaun Delmolino, 50, of Dalton, complained of injuries and was transported to Berkshire Medical Center by ambulance. The extent of Delmolino's injuries are unknown but are not believed to be life-threatening.
     

Pittsfield Man Charged With Murder

PITTSFIELD, Mass. — A city man has been charged in the fatal July 4 shooting of 39-year-old Paul E. Henry.
 
J.C. Chadwell, 39, of Seymour Street on Monday entered a plea of not guilty in Berkshire Superior Court on a single count of murder. Chadwell is accused of shooting Henry on John Street on July 4, 2017.
 
Police responded to a report of a shooting in the area of Durant Park around 11:30 on the night of July 4. Henry was pronounced dead by emergency medical technicians on the scene. An autopsy ruled the cause of death as a gunshot wound to the chest.
 
Judge Mark Pasquariello on Monday ordered Chadwell to be held at the Berkshire County House of Correction without the right to bail. A pre-trial hearing is scheduled for March 14.
 
Chadwell was arrested on a warrant by police on Friday night. The shooting apparently was related to a dispute between the two men about several years' old debt. 
 
The investigation was conducted by members of the Pittsfield Police Department Detective Bureau with assistance from the Berkshire County Sheriff's Department, State Police detectives assigned to the District Attorney's Office, members of the Berkshire Law Enforcement Task Force and the Massachusetts State Police Firearms Identification Section.

Cases heard before Judge John Agostini on Monday, February 5.
 
Jason Pennell, 29, of Holyoke pleaded guilty to a single count of possession of heroin.
 
He was ordered to serve 120 days at the Hampden County House of Correction. The charge stems from the execution of a search warrant in Williamstown on January 18, 2017.
 
A single count of conspiracy to violate drug laws was dismissed by the state.

Cases heard before Judge John Agostini on Monday, January 29.
 
Devon Fitts, 35, of Pittsfield pleaded guilty to single counts of possession of heroin with intent to distribute, possession of cocaine with intent to distribute, and possession of ammunition without a firearm identification card.
 
He was ordered to serve concurrent 18-month sentences at the Berkshire County House of Correction on the drug charges. He was given a concurrent one-year sentence on the possession of ammunition charge.
 
The charges stem from the execution of a search warrant on Montgomery Avenue in Pittsfield on March 17, 2016.
 
Isaac Harris-El, 42, of Watervliet, N.Y. pleaded guilty to two counts of assault and battery on a disabled person, and two counts of caretaker abuse on a disabled person.
 
He was given a suspended one-year sentence at the Berkshire County House of Correction on placed on one-year probation on one count of assault and battery and one count of caretaker abuse. The other charges were continued without a finding for a year.
 
Harris-El assaulted two students while working at Eagleton School between August 1, 2014, and December 31, 2015.
 
Two counts of caretaker abuse on a disabled person and single counts of assault and battery causing serious bodily injury, assault and battery by means of a dangerous weapon, and assault and battery were dismissed by the state.
 
Cases heard before Judge John Agostini on Tuesday, January 30.
 
Charles Davis, 36, of Lanesborough pleaded guilty to a single count of assault and battery.
 
Davis was ordered to serve 385 days at the Berkshire County House of Correction. The charge stems from an incident involving a 48-year-old man in Pittsfield between December 1, 2016 and December 31, 2016. 
 
A single count of assault by means of a dangerous weapon was dismissed by the state.
 
Joseph Loftus, 37, of Pittsfield pleaded guilty to single count of kidnapping, armed robbery, larceny over $250, intimidation of a witness, and identity fraud.
 
He was ordered to serve two and a half years at the Berkshire County House of Correction on the intimidation of a witness charge. He was given two and a half years on the identity fraud charge. He was given one-year probation on the other charges.
 
The incident happened in Pittsfield on December 14, 2016 and involved a 53-year-old woman. A single count of fraudulent use of a credit card was dismissed by the state.
 
Cases heard before Judge John Agostini on Wednesday, January 31.
 
Shaun Dufur, 30, of Adams pleaded guilty to single counts of breaking and entering a building, conspiracy, larceny from a building, and wanton destruction of property.
 
He was ordered to serve two and a half years at the Berkshire County House of Correction on the breaking and entering charge. He was two years on the other charges. He was sentenced to a total of four and a half years.
 
Dufur broke into a home in Hancock on May 9, 2017.
