Cases heard before Judge John Agostini on Wednesday, October 17.

Orlando Roberts, 31, of Pittsfield pleaded guilty to single counts of possession of cocaine with intent to distribute, conspiracy to violate drug laws and possession of lysergic acid diethlamide.

He was sentenced to 190 days at the Berkshire County House of Correction. The charges stem from the execution of a search warrant in Pittsfield on February 4, 2010. An additional count of drug violation in a school zone was dismissed by the state.
     

Richmond's New Fire Command Vehicle on the Road

RICHMOND, Mass. — From the most recent town newsletter is the report that the new Fire Command vehicle has been delivered and is in active service.

Town meeting approved taking $40,000 from free cash for the new 4-wheel drive last May to replace a 2005 Ford Taurus that officials called "ill-equipped" for the Fire Department's needs.
     

Pittsfield Man Pleads Not Guilty To Canyon Ranch Bomb Threat

PITTSFIELD, Mass. — A city man had not guilty pleas entered on his behalf in Berkshire Superior Court on allegations of making a bomb threat and setting fire to a Canyon Ranch building.

Miles Arnspiger, 23, of Pittsfield had not guilty pleas entered on single counts of burning a building and making a bomb threat causing serious public alarm.

Judge John Agostini released Arnspiger on personal recognizance on the condition that he stay away from Canyon Ranch, wear a GPS monitor and abide by a curfew.

Arnspiger allegedly set fire to an outbuilding at the Lenox resort and made a bomb threat on May 19, 2012 and August 9, 2012.
     

Superior Court Briefs: October 9 - October 11

Cases heard before Judge John Agostini on Tuesday, October 9.

Jason Bushey, 31, of Pittsfield had not guilty pleas entered on his behalf on two counts of rape, four counts of indecent assault and batter on a person who has attained age 14 and a single count of intimidation of a witness.

He was released on personal recognizance on the condition that he has no contact with the alleged victim.

Bushey allegedly sexually assaulted a women who is now 18 years old in Pittsfield between February 1, 2011 and October 21, 2011. He is also accused of intimidating the alleged victim on June 15, 2012.

Crystal Bushey, 31, of Pittsfield had a not guilty plea entered on her behalf on one count of reckless endangerment of a child.

She was released on personal recognizance on the condition that she have no contact with the alleged victim.

Bushey is accused of knowing about the sexual abuse of a woman who is now 18 years old and failed to report it to authorities. The incidents allegedly occured in Pittsfield between February 1, 2011 and October 21, 2011.

Shaun Race, 29, of Pittsfield had not guilty pleas entered on his behalf on single counts of operating a motor vehicle under the influence of drugs, motor vehicle homicide while under the influence of drugs, child endangerment while operating under the influence and operating a motor vehicle with a suspended license.

He was released on personal recognizance on the condition that Race remain drug free and undergo drug testing.

Race was allegedly the operator of a motor vehicle involved in a single vehicle accident in Lee on May 12. The accident killed 30-year-old Mayra Demedeiros. The couple's one month old baby was in the car but was not injured.

Jason Lemieux, 31, of Savoy pleaded guilty to two counts of threat to commit a crime to wit: murder, two counts of assault and battery by means of a dangerous weapon, eight counts of assault and battery, one count of intimidation of a witness and one count of misleading a police officer.

He was sentenced to serve concurrent three and a half to six years at the Massachusetts Correctional Institution at Cedar Junction on the charges of threat to commit a crime to wit: murder, intimidation of a witness, misleading a police officer and assault and battery by means of a dangerous weapon.
 
He was given a concurrent two and a half year suspended sentences at the Berkshire County House of Correction on the other charges and placed on three years probation during which he will be on house arrest and required to wear a GPD monitor.
 
The incidents involved a 31-year-old woman in Northern Berkshire County between August 1, 2009 and September 27, 2010. Three counts of rape were dismissed by the state.

Cases heard before Judge John Agostini on Thursday, October 11.

Tresa Moody, 47, of Pittsfield pleaded guilty to a single count of conspiracy to violate drug laws, to wit: possession of cocaine.

She was ordered to pay a $250 fine. Moody conspired with others to possess cocaine in Pittsfield on March 7, 2012.
     

Seven Fire Departments Fight Blaze At Hancock Restaurant

HANCOCK, Mass. — Fire caused heavy damage to Powder Hounds Restaurant on Wednesday afternoon and one firefighter was injured fighting it.

According to Fire Chief Dave Rash, the Fire Department received the call at about 2 p.m. and arrived to find "heavy smoke" and for the next two hours more than a half dozen fire departments worked to snuff it out.

"One Stephentown (N.Y.) firefighter has a high level of CO in his blood. He got some smoke but we're going to have him transported to BMC to get checked out," Rash said at the scene.

No other injuries were reported.

Rash said the fire stayed completely on the west end of the second floor — in space used as the restaurant's office.

"It's was an old facility that's been modified and added onto and renovated so there was a lot of different stages of construction and different areas that were walled off. So it was really difficult to get to the fire," he said.

Departments from Lanesborough, Cheshire, Dalton, Williamstown, Stephentown and Hinsdale assisted in finally overcoming the Brodie Mountain Road blaze. New Ashford and Richmond were covering stations and Village Ambulance was on-scene.

No cause had yet been determined; the department was waiting for the state fire marshal.

Rash said the owner was receiving a delivery and preparing to open the business when the fire was detected by staff. The blaze was controlled at about 4 p.m. but firefighters will remain on scene to check for hotspots.

"We're doing a thorough investigation," Rash said. "We'll be here probably most of the night."
